A lawsuit against current Alabama defensive back Dre Kirkpatrick Jr. has been thrown out by Cleveland County Judge Thad Balkman on Thursday afternoon, according to a report by Davis Cordova of the Norman Transcript.

Judge Balkman threw out the lawsuit against Kirkpatrick, who was sued by Holden Moxley, for an incident during Oklahoma's 24-3 upset of Alabama during the 2024 college football season. Before fans stormed the field, and while fans were rushing to tear down the goalposts on the field, Oklahoma displayed warnings of personal harm on the video boards around the stadium, and the public address announcer gave verbal caution. According to Cordova's report, Moxley alleged that Kirkpatrick struck him in the back of the head, resulting in a concussion. The incident happened when Oklahoma fans rushed the field too early, and the incident was captured on video.

 

 

 

The case was thrown out after Balkman ruled that Moxley had plenty of warnings and notices about personal harm, saying Moxley knew about the risk of field storming and is personally liable for any harm inflicted.

 

Kirkpatrick was a freshman at the time and is now entering his third year with Alabama as a defensive back. He missed the final seven games of Alabama's 2025 season after an arrest during the team's bye week, but returned to the roster to start spring practice.
